Separate spousal property: document contributions to your partner’s assets

Personal Status Law No. 41 of 2024, effective from 15 April 2025, addresses separate finances and claims for contributions. Applying these rules requires clarity about the law governing your relationship and the nature and evidence of the contribution.

  1. First identify which personal-status rules govern the relationship and financial issue. Nationality, religious status, a valid choice of law and the timing of events may matter. This article explains Law No. 41 of 2024 where it applies; the same result should not be assumed for every marriage or asset in every country.

  2. Article 51 recognises each spouse’s separate financial estate. The wife controls her property, and the husband cannot dispose of it without her consent. Marriage itself does not make every asset jointly owned or automatically give either spouse half of the other’s property.

  3. The same article allows a spouse who contributed to developing the other’s property, building a home or a similar undertaking to claim their share from the other spouse or the heirs. The contribution and resulting entitlement must be established; this is different from an inheritance share or a fixed percentage of all assets.

  4. When paying towards your spouse’s property, construction or investment, document the payment’s purpose and the agreement on ownership or repayment. Keep receipts, transfers, contracts, invoices and relevant messages, and distinguish a gift, loan and contribution. Any separate asset-registration requirements must also be addressed.

A practical next step

Before a substantial transfer, record the contribution and agreed right. If a dispute has arisen, organise payment and ownership documents to assess the applicable law and the claim’s value.
