One family can have connections to several legal systems
A marriage may have been registered in Iran while the family lives in Dubai and holds assets elsewhere. A question about divorce, maintenance, marital financial claims or children therefore needs a precise starting point: what decision is needed, and where must it have practical effect?
Do not rely solely on nationality or the place of marriage. Jurisdiction, applicable law and the effect of a decision in another country are separate questions. This article helps organise information; it does not predict the outcome of a family case.
Identify the legal framework before assuming the result
Federal Decree-Law 41 of 2024 on Personal Status includes rules for non-UAE nationals, with scope to invoke a person’s law or an agreed law within legally permitted limits. This is not an unrestricted right to choose any legal system.
Federal Decree-Law 41 of 2022 on Civil Personal Status and associated provisions establish a separate framework for non-Muslims. Being a foreign resident alone does not establish that its civil marriage or divorce rules apply to every Iranian family. Clarify the parties’ circumstances first.
Prepare facts by subject
Create a short chronology of marriage, residence and earlier proceedings. Record where each person and any children currently live. Mark uncertain dates as uncertain until documents establish them. For financial questions, list each relevant amount with its currency, account holder, location and supporting record.
Separating school expenses from housing costs, for example, makes the factual picture clearer. It does not establish either person’s legal entitlement or liability.
- Identity and residence records; the full marriage document and its conditions.
- Children’s birth records and relevant information about residence, education and needs.
- Existing orders, agreements, notices and case references in every relevant country.
- Financial documents connected to the issue, with estimates clearly identified.
Distinguish translation from attestation
For an Iranian document, first check the receiving authority’s language and formal requirements. UAE Ministry of Foreign Affairs attestation requirements address original documents, Arabic or English or official translation, and prior certifications. Verify the route for the document and issuing country.
Before commissioning every translation, identify what is actually needed. Check names and dates against original records and passports, and retain complete copies. Translation of a document and recognition or enforcement of a foreign judgment are different issues.
Make questions involving children specific
For travel or a proposed move, provide the plan, timing and any existing order for review. Establish the consents or permissions relevant to the particular case before acting. The result reached for another family does not determine what is permitted for yours.
Finish with three priorities and identify what is urgent. Coordinated review in the relevant countries can help expose consequences that might otherwise be missed when only one part of a cross-border situation is considered.
