Can payment under a disputed UAE bank guarantee be stopped?

An objection to the underlying commercial deal does not normally require the bank to withhold payment. A letter of guarantee has its own terms and legal effect. Where the federal Commercial Transactions Law applies, stopping payment through attachment requires an enforceable court order or judgment based on serious, substantiated grounds.

  1. Check the guarantee itself: beneficiary, amount, expiry, conditions for a demand, amendments and any incorporated rules. A conditional guarantee must be distinguished from an unconditional undertaking. A dispute over defective work or an unpaid invoice does not alone establish that a demand is invalid.

  2. Article 417 limits a bank’s ability to refuse payment because of disputes in the underlying relationships. Its court-attachment exception is not activated by a complaint or a customer instruction. The evidence and urgency must support the particular judicial relief sought.

  3. Assess the position before payment and before the guarantee expires. Once payment has been made, recovery involves a different claim and evidence. Any application should accurately disclose the contract, demand and relevant correspondence; urgent relief is not a guaranteed outcome.
