DIAC’s published calculation uses the value in dispute, including counterclaims and set-offs, for institutional and tribunal charges. Budget separately for legal advice, experts, translations and enforcement. An online calculation is an estimate, not a complete quotation for all stages of the dispute.
The 2022 Rules ordinarily set six months for the final award from transmission of the file to the tribunal, subject to extensions and other applicable provisions. This is not six months from your first enquiry or a guarantee of payment by that date.
Ask whether expedited proceedings are available, what evidence is needed and which events could increase the budget. Consider the opposing party’s assets and a documented settlement option alongside the strength of the claim. Winning an award and collecting it require separate planning.
A practical next step
Prepare the arbitration clause, claim and counterclaim estimates, document volume and location of assets, then request a staged cost and timing assessment.
